Safer Intersections Official Contest Rules

The Safer Intersection Contest ("Contest") allows Participants (as defined below) to nominate and cast votes to select the Winning Municipality (as defined below) to receive the Prize (as defined herein). Subject to these Contest Rules, the Contest is free to participate for both Participants and nominated municipalities, including the Winning Municipality. NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO PARTICIPATE OR WIN. VOID WHERE PROHIBITED OR LIMITED BY LAW.
1. Sponsor
The Sponsor of the Contest is Ouster, Inc., located at 350 Treat Ave, San Francisco, CA 94110, United States ("Sponsor").
2. Eligibility and Acceptance Terms
Participants: Contest submissions are only open to individuals who (i) have reached the age of majority in their state of residence at the time of entry; (ii) are legal residents of the United States (including Washington, D.C., but excluding New York, Rhode Island and Florida); and (iii) are physically residing in the United States. Verification of individual Participant's eligibility may be required at the time of submission. Submissions by ineligible Participants will be void. All federal, state and local laws and regulations regarding the eligibility of participants apply. This Contest is only open to natural persons and the following are ineligible: corporations, businesses, non-profit organizations, governmental agencies or other entities. One vote per Participant.
Winning Municipality: To receive the prize, the winning municipality must be a recognized local government entity (city, town, or county) within the United States (excluding New York, Florida and Rhode Island).
Exclusions: Employees, officers, and directors of Sponsor, its parent, subsidiary, and affiliated companies, and their immediate family members are not eligible to vote and/or participate in a capacity that could influence the outcome.
Agreement to Rules: By participating in this Contest, Participants and Winning Municipality (upon acceptance of the Prize) agree to be legally bound by the terms and conditions of these Contest Rules. By participating, Participants and Winning Municipality agree to be bound to the decisions of the Sponsor (and its authorized representatives), which are final and binding in all matters. By submitting an Entry (defined below), Participants agree to be contacted by Sponsor with Contest related communications.
Acceptance Terms: To receive the prize, the winning municipality must confirm: (i) the municipality may accept the prize as a gift to the municipality under applicable legal authorities; (ii) the municipality will comply with all conditions that apply to gifts received and accepted by the municipality, including approval and reporting requirements; and (iii) acceptance of the prize would not otherwise present a conflict of interest under applicable state or local laws (including, as applicable, relevant gift and entertainment restrictions). The prize may not be awarded to a municipality that has an open or pending public procurement process (e.g., an RFP or RFQ) involving the same or similar products as prize. The winning municipality must confirm that accepting the prize will not influence any future procurement, and that the acceptance of the prize will not confer any advantage or disadvantage on Ouster with respect to evaluation and selection in future public procurements. If the foregoing conditions are not met, the winning municipality will be disqualified, and the prize will be awarded to the next most eligible municipality as determined under the process set out in Section 5, below. The Prize is awarded "as is" without any express or implied warranty or guarantee from Sponsor, including but not limited to, the implied warranties of merchantability, fitness for a particular purpose and non-infringement. Only the Prize as described herein are available to be awarded; unless otherwise provided by law, in no event will the Sponsor be responsible for awarding more or different prizes than stated herein. Any difference between the actual value and ARV of the prize will not be awarded as cash, or otherwise unless otherwise stated.
3. Contest Period
Contest Period: The Contest begins on April 22, 2026 (the "Start Date"), and all votes must be cast by July 3, 2026 (the "End Date").
4. Prize Description & Retail Value
Prize: One (1) Bluecity NEMA Bundle, including a two (2) year free subscription to the full cloud analytics platform.
Installation: Sponsor does not provide installation. Participants are fully responsible for installing the Prize.
Approximate Retail Value (ARV): The ARV of the prize system is estimated at $24,000. The final value is dependent on the specific configuration required for the installation site.
5. Rules, Winner Selection & Notification
Rules of Engagement: Participants nominate an intersection for the Safety Innovation Grant by identifying locations that would most benefit from high-resolution, 24/7 multimodal analytics. Evaluation criteria for the grant prioritize sites with complex traffic flows, diverse road-user types (pedestrians, cyclists, and motorists), and varying environmental conditions where digital lidar can provide the most impactful safety insights. These community nominations serve to identify the top-priority candidate sites for the deployment of Ouster's intelligent infrastructure technology.
Selection: The Winning Municipality will be determined on July 3, 2026. There is only one (1) Grand Prize winner. The winner is the single municipality associated with the intersection that receives the highest number of verified unique votes cast via safer-intersections.com.
Notice; Contingency Process: Sponsor will attempt to make contact with the first-place Winning Municipality to coordinate the Prize. Being awarded the Prize is subject to: (i) the Winning Municipality acceptance, (ii) local government approval and feasibility (including acceptance of the terms in Section 2 above), (iii) the Winning Municipality's acceptance of applicable agreements (e.g. terms and conditions & EULA) from the Sponsor, and (iv) the completion of required legal and company forms. If Sponsor is unable to reach a formal agreement or obtain approval from the first-place Winning Municipality within a reasonable timeframe, Sponsor will attempt to contact the second-place Winning Municipality, and so on, until the Prize is successfully awarded.
Publicity: The Winning Municipality agrees to support Sponsor in a joint press release and marketing communications.
6. Data Privacy and Collection
Verification: To ensure the integrity of the Contest and prevent automated voting, Participants must submit a valid email address when they vote.
Compliance: By providing an email address, Participants grant express permission for Sponsor to collect this personal information for the purpose of Participant voting verification and for future marketing communications. See Privacy Policy.
Opt-Out: Participants may opt out of future marketing communications at any time. No tracking cookies are used to monitor browsing habits.
7. Taxes and Reporting
Tax Liability: All federal, state, and local taxes on the prize are the sole responsibility of the Winning Municipality.
Reporting: Since the ARV exceeds $600, Sponsor will issue an IRS Form 1099-MISC to the Winning Municipality for the value of the prize.
Shipping Tax: Under California law, property shipped from California to an out-of-state location through a common carrier is generally not subject to California sales tax. Sponsor will pay shipping.
8. Limitation of Liability
By participating and/or accepting the Prize, Participants and the Winning Municipality agree to release and hold harmless Sponsor and its affiliates from any and all liability or any injuries, loss, or damage of any kind arising from or in connection with the Contest or any prize won.
DISPUTES/CHOICE OF LAW: EXCEPT WHERE PROHIBITED, EACH PARTICIPANT AGREES THAT: (1) ANY AND ALL DISPUTES, CLAIMS AND CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THIS CONTEST OR ANY PRIZE AWARDED SHALL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION, AND EXCLUSIVELY BY STATE OR FEDERAL COURTS SITUATED IN SAN FRANCISCO COUNTY, CALIFORNIA, (2) ANY AND ALL CLAIMS, JUDGMENTS AND AWARDS SHALL BE LIMITED TO ACTUAL OUT-OF-POCKET COSTS INCURRED, BUT IN NO EVENT ATTORNEYS' FEES, (3) NO PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR OTHER DAMAGES, INCLUDING, WITHOUT LIMITATION, LOST PROFITS, MAY BE AWARDED (COLLECTIVELY, "SPECIAL DAMAGES"), AND (4) PARTICIPANT HEREBY WAIVES ALL RIGHTS TO CLAIM SPECIAL DAMAGES AND ALL RIGHTS TO SUCH DAMAGES MULTIPLIED OR INCREASED. CALIFORNIA, WITHOUT REFERENCE TO CHOICE OF LAW RULES, GOVERNS THE CONTEST AND ALL ASPECTS RELATED THERETO.
All entries become the property of the Sponsor, and the Participants agree that the Sponsor shall have sole and exclusive rights to use the Contest entry materials in any marketing, publication, or other forum. The Sponsor assumes no responsibility for lost, delayed, incomplete, incompatible or misdirected entries. All entries that are incomplete, illegible, damaged, irregular, have been submitted through illicit means or do not conform to or satisfy the conditions set forth in these Contest Rules, may be disqualified by the Sponsor. This Contest is subject to all applicable federal, state and municipal laws. The decisions of the Sponsor with respect to all aspects of this Contest are final and binding on all Participants without right of appeal, including, without limitation, any decisions regarding the eligibility/disqualification of entries and/or Participants.
The Sponsor reserves the right to withdraw or amend this Contest (or to amend these Rules) in any way, in the event of an error, technical problem, computer virus, bugs, tampering, unauthorized intervention, fraud, technical failure or any other cause beyond the reasonable control of the Sponsor that interferes with the proper conduct of this Contest as contemplated by these Rules. Any attempt to deliberately damage any website or to undermine the legitimate operation of this Contest is a violation of criminal and civil laws and should such an attempt be made; the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law. The Sponsor reserves the right to cancel or suspend this Contest, or to amend these Rules without prior notice or obligation, in the event of any accident, printing, administrative, or other error of any kind.
